1. Who we are
ggbussey.com (the "Webstore") is operated by GEORGE G. BUSSEY & CO. PTY LIMITED, an Australian proprietary limited company (ACN 655 579 730 / ABN 71 655 579 730) with its registered office at 8/1 O'Connell Street, Sydney, NSW 2000, Australia ("Bussey", "we", "us", "our"). You can contact us at hello@ggbussey.com or via the channels listed on our Contact page.
We act as the seller for all orders placed through the Webstore.
2. These terms
By placing an order, browsing the Webstore, or registering for an account, you agree to these Terms of Service & Sale (the "Terms"), our Privacy Policy, our Cookie Policy, our Shipping Policy, our Returns, Refunds & Cancellations Policy, and our Acceptable Use & Website Terms. Together these form the agreement between you and us.
We may amend these Terms from time to time by posting an updated version on the Webstore. The version in effect at the time you place an order governs that order. Changes will not affect orders already placed and accepted.
These Terms are written in, and governed by, the English language. Any translations are provided for convenience only, unless otherwise required by applicable law.
If you do not agree to these Terms, please do not use the Webstore or place an order.
3. Eligibility
You must be at least 18 years of age and have legal capacity to enter into a contract to place an order. By placing an order you confirm both. We sell to consumers (for personal, non-commercial use). If you are a business customer or trade buyer, please contact us at trade@ggbussey.com to discuss separate terms.
4. Products, availability & descriptions
We take considerable care to ensure that the visual representations of our products on the Webstore are representative of the colour, design, texture, and style of the original products. Despite this care:
- Natural materials (cashmere, lambswool, leather, willow) carry natural variation in colour, grain, and texture. Slight variation between item and image is to be expected and is not a defect.
- Devices display colour differently. Slight visual differences, distortions, or variations may occur when compared to the original product.
- Dimensions may vary slightly from those displayed.
- Products are subject to availability. We may withdraw or suspend products at any time and may limit quantities purchased per customer, per order, or per address.
- Where a sizing chart, fabric composition, or care instruction is provided, it is intended as a guide. If you are unsure, contact us at care@ggbussey.com before ordering.
5. Pricing, payment & currency
Prices are displayed in your local or chosen currency where supported, or in another presentation currency. The currency that applies to your order will be confirmed at checkout before you pay. Due to exchange-rate fluctuation, prices may change from time to time; however, the total order amount as presented at checkout when completing your order will not be affected by subsequent exchange-rate changes.
Prices may be inclusive or exclusive of tax depending on your delivery destination. Whether the displayed price is inclusive or exclusive of tax will be clearly shown at checkout. Customs duties and import taxes (where applicable) are addressed in our Shipping Policy and clause 7 below.
We accept the payment methods displayed at checkout, which may include credit and debit cards, Apple Pay, Google Pay, Shop Pay, PayPal, and other methods we may introduce from time to time. Your bank or card issuer may impose additional charges (such as foreign-transaction or cross-border fees) determined by your relationship with that institution. We are not liable for, and may not have knowledge or control over, those charges.
If you used a payment method that supports pre-authorisation (e.g. most credit cards), the payment amount will be authorised on order and captured (charged) at the latest on dispatch. Other methods (such as PayPal or e-wallets) may be charged immediately on order. The full amount of your order will be charged even if the shipment is split.
Payment is processed by our payment service providers; we do not store full card details on our servers.
6. Forming the contract
The information contained in these Terms and the data presented on the Webstore and at checkout serves only as an "invitation to offer". When you submit your order at checkout, you are making an offer to purchase. We will acknowledge receipt of your order by email; this acknowledgment is not acceptance.
A binding contract is formed only when we accept your offer by sending a dispatch confirmation ("Order Confirmation"). The contract is concluded in Australia, the dispatch country.
We may decline or cancel an order, in full or in part, before or after acknowledgment, including for the following reasons (without limitation):
- the product is unavailable, including where it has been listed in error;
- the order fails fraud, sanctions, or denied-parties checks;
- the order is deemed abnormal, or is suspected of being placed in bad faith (for example, an unusual quantity at a clearly mispriced rate);
- the order is not placed by a consumer;
- the provided payment information cannot be verified or pre-authorised;
- we are unable to deliver to your destination; or
- the order is in breach of these Terms.
If we cannot accept all items in your order, we may dispatch the items we can supply and refund items we cannot. If a price has been listed in error (a "genuine pricing error" — for example, an unusually low price absent of a legitimate sale), we may decline or cancel the affected order without obligation to honour the listed price, and will refund any amount paid. We are not obliged to provide a specific reason for declining or cancelling any order unless required by applicable law.
7. Duties, taxes & importer of record
For international orders, where we are able to we collect duties and import taxes at checkout so that the price you pay is the final price ("delivered duty paid" or DDP). Where DDP is not available for your destination, your order will be sent on a "delivered duty unpaid" (DDU) basis, and the carrier or customs authority may invoice you for duties and import taxes on delivery. Whether your order is DDP or DDU will be made clear at checkout.
Where you are receiving an international shipment from us, you are the "importer of record". We (or our agent) facilitate importation on your behalf, acting as your agent. By agreeing to these Terms you authorise us and our agents to: (a) transact with relevant authorities; (b) complete, submit, and execute documents for the import and clearance of your order; (c) facilitate payment of duties and taxes; and (d) where applicable, return your order.
Before ordering, please check that the product can be lawfully imported into your destination and that any product standards (e.g. safety, labelling) applicable in your destination are met. Products and their documentation (packaging, care labels) may not be in your local language. We are not liable for the suitability of products for any specific local standards unless we have specifically warranted such suitability.
If duties or taxes were not pre-paid at checkout and you fail to pay them when required, or refuse delivery without following the cancellation procedure in our Returns Policy, you may face additional charges including return shipping costs and loss of the original outbound shipping cost.
8. Delivery, risk & title
Delivery details, timeframes, costs, and the position on customs are set out in our Shipping Policy. Estimated delivery dates provided at checkout are estimates unless explicitly stated otherwise. If no specific date is given, we will deliver your order within 30 days of Order Confirmation, barring exceptional circumstances (for example, pre-orders). Different parts of your order may arrive on separate dates.
Delivery is considered complete when the product reaches the address you specified at checkout. For DDU shipments where you fail to pay required duties or taxes, delivery is considered complete on arrival at the port of entry of the destination country.
Risk of loss or damage to the goods passes to you on delivery. For consumer orders to the United Kingdom and the European Union, risk does not pass until the goods are in your physical possession (or the possession of a person you have nominated, other than the carrier). Title to the goods passes to you on the later of (a) delivery and (b) our receipt of payment in full.
9. Returns, refunds & cancellations
Your right to cancel, return, or be refunded is set out in our Returns, Refunds & Cancellations Policy, which forms part of these Terms. The Policy contains specific provisions for consumers in the European Union (14-day right of withdrawal under the Consumer Rights Directive), the United Kingdom (14-day right under the Consumer Contracts Regulations 2013), and Australia (Australian Consumer Law statutory guarantees).
Nothing in our Returns Policy or these Terms limits or excludes any non-derogable statutory right you may have as a consumer.
10. Consumer guarantees & warranties
Australian customers
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
UK customers
You have legal rights under the Consumer Rights Act 2015 that goods must be of satisfactory quality, fit for purpose, and as described. Nothing in these Terms affects those rights.
EU customers
You have legal rights under the Consumer Sales Directive (EU) 2019/771 that goods must conform to the contract for a minimum period of two years from delivery. Nothing in these Terms affects those rights.
US customers
In addition to any voluntary warranty we may offer, US consumers have rights under applicable state laws, including (where applicable) the Magnuson–Moss Warranty Act for written warranties and state-level implied warranties of merchantability and fitness for purpose. Nothing in these Terms affects those rights.
All customers — our voluntary care commitment
Beyond your statutory rights, Bussey stands behind every product we make. If you receive a Bussey product that you believe is faulty, please contact us at care@ggbussey.com with a description and photographs of the issue. We will work with you to find a fair resolution — repair, replacement, or refund — appropriate to the issue and your statutory rights.
11. Personalised & made-to-order products
Where Bussey offers personalised, monogrammed, or custom-made products, those products are made specifically for you based on the details you provide. Please ensure all customisation details are accurate when placing your order. Personalised products are non-returnable and non-refundable, unless faulty or damaged on receipt, save where applicable law preserves a right of return (the EU Consumer Rights Directive and UK Consumer Contracts Regulations both contain a "made-to-consumer-specifications" exception to the 14-day withdrawal right — see our Returns Policy for detail). Once Order Confirmation is sent, you cannot change or cancel an order for personalised products.
We reserve the right to refuse personalised orders at our discretion (for example, where the requested customisation contains language we consider inappropriate). In such cases the order will be cancelled and fully refunded.
12. Limited collections, drops & campaigns
Bussey works to a small-drop model. We may from time to time offer limited-time or limited-quantity campaigns, drops, raffles, or competitions ("Campaigns"). Campaigns may be subject to specific terms ("Campaign Rules") in addition to these Terms. Campaign Rules, if applicable, will be made available on the relevant Campaign landing page or in the order pathway. In case of any conflict between these Terms and the Campaign Rules, the Campaign Rules will prevail.
13. Intellectual property
All content on the Webstore — including the G.G. Bussey name, the G.G.B. arrow trademark, logos, wordmarks, photography, illustration, product designs, written copy, archival reproductions, and the look and feel of the site (collectively, "Materials") — is owned by or licensed to us. You may not sell, reproduce, distribute, communicate, modify, display, perform, or prepare derivative works of any Materials for any public or commercial purpose without our prior written permission.
You may download one personal copy or print one personal copy of Materials for non-commercial, educational, private, or domestic use, provided you do not modify or remove any copyright, trademark, or other proprietary notice. You may share content from the Webstore on social media for personal, non-commercial use, provided you do not alter or remove our trademarks or attributions.
G.G. BUSSEY®, the G.G.B. arrow device, and DEMON DRIVER® are trademarks of George G. Bussey & Co. Pty Limited, registered or pending registration in [list of jurisdictions — to be confirmed].
14. Accounts
You may create an account on the Webstore to streamline checkout, track orders, and save preferences. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Contact us promptly if you believe your account has been compromised. We may suspend or terminate accounts that we reasonably believe have been used to breach these Terms, engage in fraud, or otherwise misuse the service.
15. Liability
Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any liability that cannot be limited or excluded under applicable law, including under the Australian Consumer Law, the UK Consumer Rights Act 2015, the EU Consumer Sales Directive, and applicable US state consumer-protection law.
Subject to the above, our total liability to you in respect of any order shall not exceed the amount you paid for the goods to which the claim relates. To the fullest extent permitted by law, we are not liable for any loss that is not a reasonably foreseeable consequence of our breach, or for loss of profit, loss of business, loss of goodwill, or pure economic loss.
16. Force majeure
We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including (but not limited to) extreme weather, natural disasters, acts of government, war, civil unrest, pandemic, strike action, carrier failure, customs delay, or supply-chain disruption affecting our manufacturing partners. Where such an event occurs, we will use reasonable efforts to mitigate its effect on your order and will keep you informed.
17. Governing law & your statutory rights
These Terms and any contract formed under them are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
However: if you are a consumer resident in another country, you have the benefit of any mandatory provisions of the law of the country in which you reside that cannot be derogated from by agreement. Nothing in this clause affects your rights to rely on those mandatory provisions. In particular:
- Australian consumers retain the full benefit of the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).
- UK consumers retain the full benefit of the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- EU consumers retain the full benefit of the Consumer Rights Directive (2011/83/EU), the Consumer Sales Directive (EU) 2019/771, and implementing national legislation.
- US consumers retain the full benefit of applicable state and federal consumer-protection law.
18. Dispute resolution
We hope you never have cause to be dissatisfied. If you are, please contact us first at care@ggbussey.com so we can try to resolve the issue.
EU consumers may also access the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. UK consumers may seek to resolve disputes through alternative dispute resolution. Australian consumers may contact the Australian Competition and Consumer Commission (accc.gov.au) or their state's fair-trading authority.
19. Severability, assignment & entire agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in force. We may assign these Terms to a successor or affiliate; you may not assign these Terms without our consent. These Terms (together with the policies they incorporate) form the entire agreement between you and us in respect of orders placed through the Webstore. Clauses 13 (IP), 15 (Liability), 17 (Governing Law), 18 (Dispute Resolution), and any other clause that by its nature should survive, will survive termination.
